Your tour deposit (minus non-refundable race registration fees) is refundable for 14 days from the date it is received unless noted otherwise below. After 14 days your deposit becomes nonrefundable, and will be forfeited should you decide to cancel your reservation. Deposits made 60+ days before a tour departs become nonrefundable on the final payment due date. If you book a tour less than 60 days before its departure date, the entire tour cost becomes non-refundable after 7 days. Cancellations must be in writing: sent via email to [email protected], or mailed to the address below. Cancellations become effective on the date received by Finish Line Travel.

Tour Terms & Conditions

This document outlines what Finish Line Travel (“FLT”) provides when you sign up for an FLT tour, and what you agree to do while on tour with FLT (“Tour Conditions”). By signing up for a tour with FLT you are agreeing to these Tour Conditions so please read the document carefully before you complete your reservation request.

TOUR PRICE GUARANTEE

Our tour prices do not include airfare and are subject to change without notice due to the unpredictability of currency rates and trip costs. However, your price for the tour you’ve selected will be locked and guaranteed the moment we receive your deposit. For current tour prices, visit www.FinishLineTravel.com or call us at 970-445-0968.

INCLUDED IN THE PRICE OF EACH TOUR

Sightseeing tours by a private guide, including admissions to sights seen as a group; all breakfasts (lunches and dinners vary – please see your specific tour itinerary); accommodations each night, in 4- and 5-star hotels (where available); all transportation from your arrival at the airport through your departure airport or train station at the end of the tour (does not include optional activities or independent travel during the tour); all FLT guide, local guide, and driver tips;

NOT INCLUDED IN THE PRICE OF EACH TOUR

Airfare from your hometown to the city in which the tour begins; costs of passports and visas; personal expenses such as beverages, laundry, room service, and meals not specified; communications charges; and a Travel Protection Plan. Additional baggage fees levied directly by the airline(s) may apply and are subject to change at any time. You should confirm directly with your airline(s) prior to departure.

ITINERARIES ARE SUBJECT TO CHANGE

We need to be flexible enough to take advantage of whatever comes our way so that we may provide you with the best possible tour. If a scheduled activity is not available due to weather or other circumstances, we will do our best to substitute another equivalent activity. Uncompleted portions of the tour itinerary are not cause for a refund.

TOUR PAYMENTS

To reserve a seat on an FLT tour you must agree to these Tour Conditions and provide us with a deposit of 15% of the tour price per person. We accept MasterCard, Visa, and American Express for all tour payments. We also accept your personal check from a US bank account (or a bank draft/money order drawn on a US or Canadian bank) made payable to “Finish Line Travel” in US dollars. Your final tour payment is due in our office at least 60 days prior to the start of the tour, in one payment. Your final payment due date will be listed on your initial confirmation letter and tour invoice. Missing the final payment deadline may result in your being removed from the tour! If you sign up for a tour less than 60 days before its departure, the entire tour price must be paid, and the deposit portion is nonrefundable after 7 days.

SINGLE-OCCUPANCY SUPPLEMENT

If you are traveling solo, you are required to pay a single-occupancy supplemental charge. (Please contact us for current single-occupancy supplement prices.)

RETURNED PAYMENTS

If a payment to FLT is returned unpaid for any reason, we will assess a $35 returned-item fee per occurrence. The fee(s) will be added to the applicable tour balance and must be paid in full prior to your tour departure.

TOUR MINIMUMS

FLT runs only small-group tours.  We require a minimum of 6 guests to conduct a tour (unless otherwise specified).  In the event that fewer than 6 guests are registered for a tour 60 days prior to the tour date, FLT may cancel the tour.  We recommend Travel Insurance to protect your vacation investment and we recommend not purchasing airline tickets until the tour has been confirmed.  Please contact us for more information.

 TOUR CANCELLATIONS

If we cancel a tour you have reserved, the entire amount you have paid to FLT for the applicable tour will be refunded to you within 30 days after the tour’s cancellation. Or, you may choose to transfer to another tour with seats available within 30 days. Once this occurs, FLT and its representatives have no other obligations to tour members on canceled trips including any additional costs or fees related to the issuance and/or cancellation of airline tickets or other travel reservations not made by FLT. (We recommend Travel Insurance to protect your vacation investment.)

PASSPORTS AND VISAS

A valid passport is required for U.S. citizens traveling on our international trips. You will be notified if your destination requires a visa for U.S. citizens. All passports must contain at least five blank pages and must be valid for six months after the completion of your trip. Non-U.S. citizens should contact the appropriate consular office for entry requirements pertaining to their trip, as we are not responsible for providing you with this information or documentation. It is the passenger’s sole responsibility to obtain and have available when necessary the appropriate valid travel documents. All passengers are advised to check with the appropriate government authority to determine the necessary documents. You may be refused to board or disembark from a vessel without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation, and you will be subject to any fine or other costs incurred by FLT which result from improper documentation or noncompliance with applicable regulations.

MEDICAL CARE AND TRAVEL PROTECTION

You recognize and agree that we are not in the business of providing medical services and/or operating medical facilities. You acknowledge that the medical benefits provided under a Travel Protection Plan (if purchased) are provided and administered by non-affiliated third parties, whose identities are listed under the travel protection plan documents. You, therefore, agree that we are not responsible for the provision of, or adequacy of, any medical care provided including but not limited to any medical care provided under a Travel Protection Plan.

During your tour, the availability of medical care may be limited or delayed. You acknowledge that all or part of your tour may be in areas where medical care and evacuation may not be available. You agree to indemnify and reimburse FLT in the event FLT elects to advance the cost of emergency medical care as well as transportation and/or lodging in connection therewith.

For your benefit, we strongly recommend that you purchase travel protection to protect against loss or damage to baggage and personal effects, trip cancellation and interruption, emergency evacuation, accidental death or injury, illness and medical expenses sustained or incurred in connection with the tour.

MEDICAL ISSUES AND SPECIAL NEEDS

You are encouraged to report any disability requiring special attention to us at the time the reservation is made, including requiring the use of special equipment. We will make reasonable efforts to accommodate the special needs of tour participants. Such participants, however, should be aware that the Americans with Disabilities Act is inapplicable outside of the United States and facilities outside the United States for disabled individuals are limited.

Most of our trips are not wheelchair or motorized scooter accessible, as wheelchair or motorized scooter assistance or accessibility in international destinations cannot be guaranteed. If your trip is wheelchair-accessible and you require a wheelchair, you must provide your own small, collapsible wheelchair. On most international trips, we cannot accommodate women past their sixth month of pregnancy and cannot accommodate service animals.

If you are unable to travel without assistance, you must be accompanied by an able companion. It is strongly recommended that persons requiring assistance be accompanied by a companion who is capable of and is completely responsible for providing the assistance. Neither FLT nor its personnel, nor its suppliers, may physically lift or assist passengers into transportation vehicles. If a traveler thinks he or she might need assistance during a trip, he or she should call us to determine what assistance might reasonably be given. The FLT cannot provide special individual assistance to passengers with special needs for walking, dining or other routine activities or personal services.

If you have a condition that requires special equipment or treatment, you must bring and be responsible for all necessary items related to your condition.
If you have a condition as contemplated herein, you travel at your own risk. The operator is not liable for any injuries or damages you may suffer relating to such a condition, including without limitation loss of special equipment, lack of assistance with or accommodation of special needs, and unavailability of medical assistance or treatment.

NOTICE CONCERNING HEALTH, SAFETY, AND SECURITY

We provide tours to a large number of countries around the world. You agree to assume responsibility for your own health and safety, and we cannot guarantee your safety at any time. Local conditions, including infrastructure, road conditions, medical care, safety, and security, may differ significantly from those found in the United States; beaches may have strong currents, riptides, or high waves and be without warning signs or lifeguards. Roads and walking/running surfaces may be uneven and unpaved and may contain loose stone, rocks, and cobblestones or unforeseen obstacles. At any given moment there are also likely to be “trouble spots” in the world in terms of war, terrorism, crime, Acts of God, civil commotions, labor trouble, and/or other potential sources of harm. The United States Department of State, Centers for Disease Control and Prevention (CDC), and other governmental and tourist organizations provide information on foreign countries, including details of local conditions in specified cities and countries according to such agency’s perception of risks to travelers. We strongly recommend you obtain and consider such information when making travel decisions. We assume no responsibility for gathering such information or providing it to you.

FLT will remove any guest who discriminates, harasses, bullies, or victimizes another guest, FLT employee or contractor or any third-party on the basis of age, disability, gender (or sex), gender reassignment, race, nationality or ethnic origin, religion or belief, sexual orientation, pregnancy and maternity, marriage and civil partnership.

PHOTOGRAPHS AND VIDEO

We reserve the right to take photographs and video during your trip. By traveling with us, you grant to us the absolute and irrevocable right and unrestricted permission to use and publish your image, or likeness, without compensation, for commercial, advertising, editorial, or any other purpose; and in any manner and medium, whether now known or hereafter devised; and to alter and composite the same without restriction and without your inspection or approval. You hereby release and discharge us from and against any and all claims, liabilities, costs, damages, and expenses of any kind arising out of or relating to the use by us of your image or likeness. If you prefer that your image or likeness not be used, you must advise us in writing, no later than 30 days prior to your departure date.

Photographs and video of your trip may be submitted to us by you or by third parties such as (but not limited to) other travelers, tour guides, crew, or staff members. By submitting such photographs or video, the party making the submission is representing and warranting (a) that the photo is their original work created solely by themselves and does not infringe the intellectual property rights of any party; (b) that they have obtained any and all necessary releases from subjects depicted in said original work; (c) that they grant to us a worldwide, royalty-free, perpetual, transferable, irrevocable, non-exclusive and fully sublicensable right and license to use, in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all commercial or other uses thereof, including without limitation, reproducing, editing, modifying, adapting, publishing, displaying publicly, creating derivative works from, incorporating into other works or modifying the photo and (d) that they hereby release and discharge us from and against any and all claims, liabilities, costs, damages, and expenses of any kind arising out of or relating to the use by us of any photo submitted.

PARTICIPATION

Although we want everyone to have a good time, it sometimes happens that someone participating in a tour can misbehave or do things that are incompatible with the health, safety, comfort, enjoyment or convenience of other members of the tour. In those circumstances, as determined exclusively by us, we have the absolute right and sole discretion to expel someone (even you) from a tour at any time. If we remove you from a trip in progress you will not be entitled to any refund, payment, compensation or credit of any kind for unused or missed services or costs incurred resulting from the termination of the travel arrangements and you will be responsible for your travel costs to return back home.

TOUR MEMBER EXPECTATIONS

Finish Line Travel tours are physically active, our hotels are centrally located, 4- and 5-star hotels (where available), but may provide fewer American-style amenities, and rooms may be smaller than you are accustomed to. On any of our tours, you assume certain obligations and responsibilities to FLT and your fellow tour members, including, but not limited to, the following:

  • You will be on-time for all tours, meals, and events.  Our transportation will depart at the scheduled time, whether you are with us or not!
  • You may need to carry or roll your own luggage over uneven pavement.
  • You must be comfortable on your feet with brisk two- to four-hour walking tours, climbing lots of stairs, hopping on and off public transportation, plus standing and walking for up to four hours inside museums and outdoors in all weather conditions.
  • We always stay in 4- and 5- star hotels (where available), but amenities are not always the same in Europe as they are in the US.  You may have to sleep with no (or inadequate) air conditioning and with street noise in some hotels.
  • We stay in many boutique hotels.  Often, each room may have different configurations and different views.  You understand that you may have a slightly different room than your fellow guests.
  • After orientation and transportation lessons, you will be able to navigate towns and cities on your own.
  • European tours can be exhausting, exhilarating, awe-inspiring, and sometimes even uncomfortable at times… You will do your best to have a good attitude!

Tour members requiring help must be accompanied by an able companion who can be entirely responsible for providing the assistance. (If you have concerns about the physical demands of our tours, please call us!)

LUGGAGE ALLOWANCE

Your single bag should not exceed the dimensions of 26”x 18”x 11” (69x45x25cm) and weight of 50lbs (22kg). We are unable to accept a second suitcase or any luggage exceeding these limits. Some holidays have more restrictive regulations than those listed above. Please refer to your Travel Documents for applicable regulations.  Due to the smaller size of hotel rooms and transportation in Europe, we recommend limiting your suitcase to one carry-on sized bag per person (approximately 21″ x 14″ x 9″).  (Please see our Packing and Luggage Tips page.)

Hand-luggage is limited to one bag per person traveling and must not exceed the dimensions of 30x28x14cm (12” x 11” x 6”). For safety reasons, wheeled carry-on bags are not suitable and will not be permitted as hand luggage on motorcoaches and minibusses. Hand-luggage bags must be small enough to store in overhead bins or under the seat in front of you on motorcoaches and other transportation.  For example, hand-luggage may consist of a backpack or similar-sized bag, plus a purse.

FLT will not accept responsibility for loss of or damage to baggage or any of the traveler’s belongings throughout the duration of the tour. Travelers are strongly encouraged to not bring valuables such as jewelry and large amounts of cash. Any such valuables should not be left in baggage out of the control of the traveler. FLT recommends that you ensure loss of or damage to baggage is included in your comprehensive travel insurance.

SMOKING POLICY

No smoking or vaping is allowed on the bus, in the hotel, or where other tour members are present.

ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION AGREEMENT

Please read the following carefully.

Long-distance running (or walking), whether a 5K or a marathon (referred to as “running” in this Agreement), can be a risky and even dangerous activity. This agreement includes important information and releases. You understand that the running and related tour activities arranged and offered by DJ Bergan Inc. d/b/a Finish Line Travel (the “Company”), involve the risk of injury or death to yourself. You understand that such risks include, but are not limited to trip-and-falls, heart attack, encroachment by crowds, assault by other runners, temperature extremes, inclement weather, dehydration, sunburn and all risks explained to me by race directors. You understand that large open areas are needed for running events and that such areas may be undeveloped, unimproved, and in an unsafe condition. You understand race directors and volunteers are not medical professionals and cannot assess your physical or emotional condition. You have consulted your personal physician or taken whatever steps you deem necessary to determine that you are in good health with no conditions that might limit your participation in running activities. You understand that no medical benefits or care will be provided to you during these running activities and that you and/or your insurance shall be solely liable to pay for any medical expenses incurred on your behalf.

You certify that you are 18 years of age or older, or that you are the legal guardian and/or parent of a minor runner with authority to sign this document on said minor’s behalf. If you are signing for a minor runner, all waivers, releases, assumptions of risk, terms of agreement, representations, acknowledgments, and certifications apply equally to such minor.

You certify that you have no physical or mental defect or medical defect or medical condition that prevents you from participating in running activities, including but not limited to pregnancy or heart, back or breathing problems.

Being aware of the risks involved, you are voluntarily applying and agreeing to participate in running and associated tour activities offered by Company. You understand that the waivers, indemnifications, releases, and assumptions of risk herein contained are consideration and part payment for the right to participate. You understand that, if you did not sign this Agreement, the cost of the activities would be significantly more.

You expressly, willingly, and voluntarily assume full responsibility for all risks of any and every kind involved with or arising from your participation in running and related tour activities arranged through Company.

Without limiting the generality of the foregoing, you hereby irrevocably release Company and their employees, agents, officers, shareholders, representatives, contractors, subcontractors, successors, heirs, assigns, affiliates, and legal representatives (the “Released Parties”) from, and hold them harmless for, all claims, rights, demands, damages or causes of action (including for attorney fees) whether known or unknown, suspected or unsuspected, arising out of the running and related tour activities, which you or your successors, heirs, or assigns may have against any of the Released Parties in connection with the running and related tour activities, and you agree to make no claims against or sue any of the Released Parties for injuries, death, or property damage that is caused by or due in any way to any of the Released Parties, including without limitation by any of their negligence, or any dangerous conditions of any property upon which the running or other tour activities may take place. You agree to hold harmless, defend, and indemnify the Released Parties (that is, defend and pay any judgment and costs, including investigation costs and attorneys’ fees) from any and all claims rights, demands or causes of action whether known or unknown, suspected or unsuspected, arising out of the running or related tour activities, which you or your successors, heirs, or assigns, or any co-participants, rescuers, or others may have against the Released Parties in connection with running and related tour activities, including those arising from the inherent risks of running activities or any act or omission of the Released Parties or any dangerous conditions of any property upon which the running activities may take place.

This Assumption of Risk, Waiver of Liability, and Indemnification Agreement is the full, final, and entire agreement between the undersigned and the Released Parties regarding the matters herein addressed.

You agree that any dispute involving the running and related tour activities will be submitted to binding arbitration in Summit County Colorado, Colorado before a single mutually selected arbitrator. Such arbitration shall be conducted in accordance with the rules determined by the arbitrator.

You further agree that this Agreement and the release, waiver, and indemnity contained herein is intended to be as broad and inclusive as permitted by applicable law, and if any portion of this Agreement (including Assumption of Risk, Waiver of Liability, Covenant not to Sue, and Indemnification Agreement) is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
